How to Review Trademark Watch Findings

Learn how to review findings detected by Trademark Watch.

Once your Trademark Watch is active, RightHub will begin scanning for trademark applications that may conflict with your existing trademarks. Here’s how to review and manage the findings within RightHub.

Step 1 - Receiving Alerts

Trademark Watch automatically scans newly published applications and notifies you of any potential conflicts. These alerts will appear both in your RightHub notifications and via email. Each alert will contain basic information about the watch itself and the number of detected applications.

Step 2 - Accessing the Findings List

To view your findings, navigate to the Trademark Watch section in RightHub. Here, you’ll see a list of all the findings generated by your active trademark watches. Every column is sortable and filterable, such as:

  • Opposition date
  • Jurisdiction
  • NICE class
  • Risk level (e.g., high, medium, low)

This overview gives you a quick snapshot of potential conflicts and helps prioritize which findings to review first.

Step 3 - Using the Comparison View

When you click on a specific finding, you’ll enter the Comparison View, which allows for a detailed review of the new trademark application. This view offers side-by-side comparison of your trademarks and the new application.

In the Comparison View, you’ll see:

  • Application details: Information such as the applicant, jurisdiction, goods/services, and NICE class.
  • Visual comparison: A side-by-side visual of the new application against your trademark.
  • Overlap detection: Highlighted similarities in jurisdictions, goods/services, or NICE classes to quickly assess potential conflicts.

Use the Comparison View to determine whether the new application poses a threat to your existing trademark.

Step 4 - Taking Action

Either directly from the table-view or after reviewing the finding in the Comparison View, you have several options for managing the finding:

  • Request Review: If you want to involve another team member, you can use the Review function. This assigns the finding to another user for their review, send them a notification and adds the status "Review" to the finding.
  • Create Matter: If the new application conflicts with your trademark, you can escalate the finding by creating an opposition matter. All relevant details will be pre-filled automatically, and the system will track the opposition deadline for you.
  • Dismiss the Finding: If the new application doesn’t pose a threat, you can dismiss the finding to remove it from your list of Unhandled findings.
  • Assign: If you want to assign the finding to someone else without changing its status, you can simply use the Assign option. This sends the finding to the selected user for their attention, pings them a notification, but without altering the current status.

Step 5 - Tracking the Status of Findings

Each finding will have a status indicating where it is in the review or action process:

  • Unhandled: The finding has not yet been reviewed.
  • Review: The finding is set for additional review, but no action has been taken.
  • Not relevant: The finding was reviewed and deemed not a threat.
  • Matter created: An opposition matter has been created and is in progress.

Regularly check the status of your findings to ensure all potential conflicts are being handled in a timely manner.

Conclusion

Reviewing and managing your Trademark Watch findings in RightHub ensures you stay on top of potential conflicts with new trademark applications. By utilizing the Comparison View to assess findings and taking appropriate action, you can protect your trademarks effectively.
